The disabled persons’ delegation is the representative body for severely disabled and equivalent disabled persons at Ostfalia.

Tasks of disabled persons’ delegation

The disabled persons’ delegation promotes the integration of severely disabled (or equivalent) persons into the company or office, represents their interests in the company or office and provides them with advice and assistance .

The disabled persons’ delegation fulfils its tasks in particular by

  1. ensuring that the laws, regulations, collective agreements, company or service agreements and administrative orders applicable in favour of severely disabled people are implemented, and in particular that the obligations incumbent on the employer under Sections 154, 155 and 164 to 167 are fulfilled,
  2. Measures that benefit severely disabled persons, in particular preventive measures, are applied for from the competent authorities,
  3. Receives suggestions and complaints from severely disabled persons and, if they appear justified, works towards their resolution by negotiating with the employer; it informs the severely disabled persons about the status and outcome of the negotiations.

The disabled persons’ delegation also supports employees with applications to the competent authorities in accordance with Section 152 (external link, opens in a new window) (1) for the determination of a disability, its degree and a severe disability, as well as with applications for equalisation with the Employment Agency.

The tasks of the disabled persons’ delegation are set out in Section 178 SGB IX (in the case of employees who are equivalent to severely disabled persons from Sections 178 in connection with 151 (3) SGB IX).

Involvement of the disabled persons’ delegation

Pursuant to Section 178 (2) SGB IX, the disabled persons’ delegation must be informed immediately and comprehensively by the employer in all matters that affect an individual or severely disabled employees as a group and must be consulted before a decision is made.

The disabled persons’ delegation must be involved, for example

  • in recruitment and appointment procedures if there are severely disabled or equivalent disabled applicants
  • in the event of the dismissal of severely disabled or equivalent disabled employees
  • at all meetings of the Staff Council (advisory participation)
  • in all relevant working groups, e.g. company integration management (BEM), occupational safety, etc.
  • in the preparation of service agreements

Elections and term of office of the disabled persons’ delegation

The regular elections of the disabled persons’ delegation take place every four years in the period from 1 October to 30 November.

All severely disabled and equivalent disabled persons employed at the office are eligible to vote in accordance with Section 177 (2) SGB IX or Sections 177 (2) in connection with 151 (3) SGB IX.

All employees who can also be elected to the staff council and fulfil the requirements of the election regulations are eligible for election.
This means that the representative of severely disabled people does not have to be severely disabled themselves.

Elections are held by secret ballot and direct election in accordance with the principles of majority voting.

The disabled persons’ delegation at Ostfalia was last elected on 3 November 2022.
