European General Data Protection Regulation (GDPR)
The European General Data Protection Regulation (GDPR) has been in force since May 2018,
- Facilitates cross-border data flows within the European Union;
- creates a standardised and directly applicable legal framework that guarantees the free movement of personal data in the European Union
- and modernises European data protection law and the fundamental right to the protection of personal data.
Effects on the Federal Data Protection Act (BDSG)
The adoption of the GDPR was followed by an amendment to the Federal Data Protection Act (BDS (external link, opens in a new window)G ) (external link, opens in a new window). In certain areas of data protection, the member states were left room for manoeuvre. The BDSG therefore serves as a national supplement to the GDPR.
The GDPR therefore takes precedence over the respective national laws of the member states.
Data protection and the protection of fundamental rights
As the protection of personal data is not an unrestricted right, it must be weighed up against fundamental rights in individual cases.
